1. Agreement to Terms

By accessing or using BodyBuddy's AI fitness and nutrition coaching service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

BodyBuddy provides AI-powered daily accountability coaching through text-based messaging. The Service includes:

• Daily text-based check-ins with our AI coach
• Photo and text-based meal and exercise tracking
• Personalized fitness and nutrition guidance
• Gamified accountability against Future You
• Progress tracking and accountability features
• Mobile and web application access

3. User Accounts

To use BodyBuddy, you must:

• Be at least 18 years old
• Provide accurate and complete information
• Maintain the security of your account
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

4. Medical Disclaimer

• The Service is for informational and motivational purposes only
• Always consult healthcare professionals before starting any fitness or nutrition program
• We are not responsible for any health issues arising from following suggestions
• If you experience any adverse health symptoms, stop using the Service and consult a doctor
• Apple HealthKit data displayed in the app is for informational purposes only and should not be used for medical decisions

4a. AI and Third-Party Services

BodyBuddy uses artificial intelligence to provide personalized coaching. By using the Service, you acknowledge and agree:

• AI Processing: Your messages, photos, and data may be processed by third-party AI providers (including OpenAI and Anthropic) to generate coaching responses, analyze meals, and provide recommendations
• Data Transmission: Content you share (text messages, photos, health data) may be transmitted to these AI providers for processing
• AI Limitations: AI-generated responses may not always be accurate. You should verify any nutritional information or exercise recommendations independently
• No Human Review: Most interactions are handled by AI without human review, though we may review conversations for quality assurance and safety
• Continuous Improvement: Anonymized data may be used to improve our AI models and service quality

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Provide false or misleading information
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Share your account with others
• Use the Service to harass or harm others

6. Payment and Billing

Subscription Plans

BodyBuddy offers a subscription-based service with the following terms:

• 7-day free trial for new subscribers
• After trial: $29/month subscription automatically begins
• Subscriptions auto-renew monthly unless cancelled
• Cancel anytime through your account settings or by contacting support
• No charges during the trial period
• You will be notified before your trial ends and billing begins

Payment Processing

Subscriptions can be purchased through either Apple In-App Purchase (IAP) or Stripe:

Apple In-App Purchase (iOS App)

• Payment is processed by Apple through your Apple ID account
• Subscriptions are managed through your Apple ID settings
• Refunds for App Store purchases are handled by Apple according to their refund policies
• To cancel, go to Settings → Apple ID → Subscriptions on your iOS device
• Apple's terms of service and privacy policy apply to these transactions

Stripe (Web or External Link)

• You agree to Stripe's terms of service and privacy policy
• Your payment information is handled directly by Stripe and is not stored by BodyBuddy
• Purchases made through Stripe are not covered by Apple's App Store refund policies
• For refund requests, please contact support@bodybuddy.app

Refunds and Cancellation

• Cancel anytime with no cancellation fees
• Cancellation takes effect at the end of the current billing period
• For App Store purchases: Request refunds through Apple at reportaproblem.apple.com
• For Stripe purchases: Refunds are handled on a case-by-case basis within 7 days of charge. Contact support@bodybuddy.app
• No refunds for partial months of service

7. Intellectual Property

All content, features, and functionality of BodyBuddy are owned by Please Clap, LLC and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

8. User Content and Uploads

Content Ownership

You retain all ownership rights to any content you upload to BodyBuddy, including photos of yourself, meals, exercises, and text messages ("User Content").

License Grant

By uploading User Content, you grant BodyBuddy a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and process your User Content solely for the purpose of:

• Providing and improving the Service
• AI analysis and coaching recommendations
• Generating your Future You avatar and transformations
• Displaying your progress and history within the app
• Training and improving our AI models (anonymized)

User Responsibilities

You agree that all User Content you upload:

• Is owned by you or you have the right to upload it
• Does not contain illegal, offensive, or inappropriate material
• Does not violate any third-party rights
• Accurately represents your meals, activities, and progress

Privacy and Sharing

• We will not sell or share your photos with third parties for marketing
• Your photos are stored securely and used only as described in our Privacy Policy
• You can request deletion of your photos at any time
• When you delete your account, your User Content will be deleted from our active systems within 30 days

9. Privacy and Data

Your use of the Service is also governed by our Privacy Policy. By using BodyBuddy, you consent to our collection and use of your data as described in the Privacy Policy.

You agree to defend, indemnify, and hold harmless Please Clap, LLC and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

13. Governing Law

These Terms shall be governed by the laws of the United States, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration or small claims court.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via the app or email. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Apple App Store Terms

If you access BodyBuddy through an Apple device, you acknowledge and agree:

• These Terms are between you and Please Clap, LLC only, not with Apple Inc. ("Apple")
• Apple has no obligation to provide maintenance, support, or warranty for the app
• Apple is not responsible for any claims relating to the app, including product liability, legal compliance, or intellectual property claims
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you
• You must comply with any applicable third-party terms when using the app
• For subscriptions purchased through Apple In-App Purchase, billing and refunds are managed by Apple according to their policies
• Purchases made through external payment links (Stripe) are not covered by Apple's refund policies

16. Apple HealthKit

If you choose to connect Apple HealthKit:

• HealthKit data access is optional and requires your explicit permission
• You can revoke HealthKit access at any time through your device Settings
• HealthKit data is used solely to enhance your coaching experience and track progress
• We do not use HealthKit data for advertising or share it with advertisers
• HealthKit data is not sold to third parties
