Terms of Service

1. Agreement to Terms

By accessing or using BodyBuddy's AI health coaching and accountability service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

BodyBuddy provides AI-powered daily accountability coaching through text-based messaging. The Service includes:

• Daily text-based check-ins with our AI coach
• Photo and text-based meal and exercise tracking
• Personalized health coaching and guidance across movement, food, sleep, and the plans your health professionals give you
• Optional visit recording: recording, transcription, and summarization of your own healthcare and wellness appointments (doctor visits, physical therapy, therapy sessions, health coaching, and similar)
• Plans built from your providers' instructions and documents you import, organized around the health professionals you work with
• Sharing plans with people you choose
• Gamified accountability alongside Future You, your avatar companion
• Progress tracking and accountability features
• Mobile and web application access

3. User Accounts

To use BodyBuddy, you must:

• Be at least 18 years old
• Provide accurate and complete information
• Maintain the security of your account
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

4. Medical Disclaimer

• The Service is for informational and motivational purposes only
• Always consult healthcare professionals before starting any new health, fitness, or nutrition program
• We are not responsible for any health issues arising from following suggestions
• If you experience any adverse health symptoms, stop using the Service and consult a doctor
• Apple HealthKit data displayed in the app is for informational purposes only and should not be used for medical decisions

BodyBuddy may store, transcribe, summarize, and remind you about instructions from your own healthcare providers (for example, through visit recording or imported documents). BodyBuddy does not provide an independent diagnosis, validate provider instructions, or replace professional advice. Your provider's original instructions control. Transcripts and summaries may contain errors, so verify anything important against the original source or with your provider before acting on it.

4a. AI and Third-Party Services

BodyBuddy uses artificial intelligence to provide personalized coaching. By using the Service, you acknowledge and agree:

• AI Processing: Your messages, photos, and data may be processed by third-party AI providers (including OpenAI, Anthropic, and Google) to generate coaching responses, analyze meals, provide recommendations, and transcribe and summarize appointment recordings and imported documents when you use those features
• Data Transmission: Content you share (text messages, photos, health data, appointment recordings, imported documents) may be transmitted to these AI providers for processing
• AI Limitations: AI-generated responses may not always be accurate. You should verify any health, nutritional, or exercise information independently
• No Human Review: Most interactions are handled by AI without human review, though we may review conversations for quality assurance and safety
• Continuous Improvement: Anonymized data may be used to improve our AI models and service quality. This does not include appointment recordings, transcripts, imported medical or training documents, or health condition notes, which are not used to train AI models

4b. Visit Recording and Recording Consent

The Service lets you record audio of your own appointments (for example, with a doctor, therapist, or trainer) so BodyBuddy can transcribe and summarize them for you. If you use this feature, you agree:

• You are solely responsible for complying with all applicable recording laws in your location, including laws that require the consent of everyone being recorded
• You are solely responsible for obtaining any required consent from the people you record (such as your providers, therapists, or trainers) before recording an appointment
• BodyBuddy may require you to confirm in the app, before a visit's content is used, that you have obtained any required consent
• You will only record appointments that you are a participant in, and you will not use the feature to record others without their knowledge where consent is required

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Provide false or misleading information
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Share your account with others (sharing a plan with another person through the app's plan-sharing feature is expressly permitted)
• Use the Service to harass or harm other users
• Harass, abuse, threaten, or send sexually explicit, demeaning, or discriminatory messages to our AI coach, staff, support team, or any other representative of the Service
• Make threats of self-harm, suicide, or violence as a means of coercing a response or otherwise manipulating the Service or its staff. (If you are in crisis, please contact 988 in the US or findahelpline.com internationally.)

We reserve the right to immediately suspend or terminate any account that violates this section, without notice and without refund, in accordance with Section 12.

6. Payment and Billing

Subscription Plans

BodyBuddy offers a subscription-based service with the following terms:

• A free trial may be offered to new subscribers
• Subscription plans are offered at different prices and billing periods (for example weekly, monthly, or annual). The price and billing period for your plan, including any promotional or discounted pricing, are displayed at the time of purchase
• After any free trial ends, the subscription you selected automatically begins at the price shown when you subscribed
• Subscriptions auto-renew for the same billing period unless cancelled
• Cancel anytime through your account settings or by contacting support
• No charges during the trial period
• You will be notified before your trial ends and billing begins

Payment Processing

Subscriptions can be purchased through either Apple In-App Purchase (IAP) or Stripe:

Apple In-App Purchase (iOS App)

• Payment is processed by Apple through your Apple ID account
• Subscriptions are managed through your Apple ID settings
• Refunds for App Store purchases are handled by Apple according to their refund policies
• To cancel, go to Settings → Apple ID → Subscriptions on your iOS device
• Apple's terms of service and privacy policy apply to these transactions

Stripe (Web or External Link)

• You agree to Stripe's terms of service and privacy policy
• Your payment information is handled directly by Stripe and is not stored by BodyBuddy
• Purchases made through Stripe are not covered by Apple's App Store refund policies
• For refund requests, please contact support@bodybuddy.app

Refunds and Cancellation

• Cancel anytime with no cancellation fees
• Cancellation takes effect at the end of the current billing period
• For App Store purchases: Request refunds through Apple at reportaproblem.apple.com
• For Stripe purchases: Refunds are handled on a case-by-case basis within 7 days of charge. Contact support@bodybuddy.app
• No refunds for partial months of service

7. Intellectual Property

All content, features, and functionality of BodyBuddy are owned by BodyBuddy HQ, Inc. and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

8. User Content and Uploads

Content Ownership

You retain all ownership rights to any content you upload to BodyBuddy, including photos of yourself, meals, exercises, text messages, appointment recordings and their transcripts, imported documents, and health condition notes ("User Content").

License Grant

By uploading User Content, you grant BodyBuddy a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and process your User Content solely for the purpose of:

• Providing and improving the Service
• AI analysis and coaching recommendations
• Transcribing, summarizing, and turning your appointment recordings and imported documents into plans
• Generating your Future You avatar and transformations
• Displaying your progress and history within the app
• Sharing plans with the people you choose, when you use the plan-sharing feature
• Training and improving our AI models (anonymized)

The training purpose above does not apply to appointment recordings, transcripts, imported medical or training documents, or health condition notes. We do not use that content to train AI models; it is processed only to provide the Service to you.

User Responsibilities

You agree that all User Content you upload:

• Is owned by you or you have the right to upload it
• Does not contain illegal, offensive, or inappropriate material
• Does not violate any third-party rights
• If it is an appointment recording, was made in compliance with Section 4b, including any required consent from the people recorded
• If it includes information about other people (such as the names and roles of your health professionals), is information you have the right to share and is limited to what is needed to use the Service
• Accurately represents your meals, activities, and progress

Privacy and Sharing

• We will not sell or share your photos with third parties for marketing
• Your photos are stored securely and used only as described in our Privacy Policy
• You can request deletion of your photos at any time
• When you delete your account, your User Content will be deleted from our active systems within 30 days

9. Privacy and Data

Your use of the Service is also governed by our Privacy Policy. By using BodyBuddy, you consent to our collection and use of your data as described in the Privacy Policy.

10. Disclaimers and Limitations

11. Indemnification

You agree to defend, indemnify, and hold harmless BodyBuddy HQ, Inc. and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. If a dispute comes up, we would rather sort it out directly, so please email us first at support@bodybuddy.app and give us a chance to fix it. If we cannot resolve it that way, any dispute may be brought in the state or federal courts located in California, or in small claims court where you live if it qualifies.

13a. Who You Are Contracting With

BodyBuddy is operated by BodyBuddy HQ, Inc., a Delaware corporation. BodyBuddy HQ, Inc. is the successor to Please Clap, LLC, which previously operated the Service. If you agreed to these Terms when Please Clap, LLC operated BodyBuddy, your agreement continues with BodyBuddy HQ, Inc. on the same terms. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets. You may not assign your rights under these Terms without our written consent.

13b. If Part of These Terms Does Not Hold Up

If a court decides that any part of these Terms cannot be enforced, that part is removed and the rest stays in effect. The sections covering intellectual property, the license you grant us for your content, disclaimers, limitation of liability, indemnification, and this section continue to apply even after your account is closed.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via the app or email. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Apple App Store Terms

If you access BodyBuddy through an Apple device, you acknowledge and agree:

• These Terms are between you and BodyBuddy HQ, Inc. only, not with Apple Inc. ("Apple")
• Apple has no obligation to provide maintenance, support, or warranty for the app
• Apple is not responsible for any claims relating to the app, including product liability, legal compliance, or intellectual property claims
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you
• You must comply with any applicable third-party terms when using the app
• For subscriptions purchased through Apple In-App Purchase, billing and refunds are managed by Apple according to their policies
• Purchases made through external payment links (Stripe) are not covered by Apple's refund policies

16. Apple HealthKit

If you choose to connect Apple HealthKit:

• HealthKit data access is optional and requires your explicit permission
• You can revoke HealthKit access at any time through your device Settings
• HealthKit data is used solely to enhance your coaching experience and track progress
• We do not use HealthKit data for advertising or share it with advertisers
• HealthKit data is not sold to third parties
